BACKGROUND: Atoka Public Schools operates the intergovernmental cooperative purchasing program known as The Oklahoma Purchasing System “TOPS,” specializing in construction-related materials and services other cooperative contract offerings wherein the products and services offered through TOPS have been awarded by virtue of the public competitive bid process. City Code authorizes the use of purchasing cooperative in limited circumstances where compliance with the Oklahoma Public Competitive Bidding Act of 1974, which only applies to public construction contracts, is not required. Entering into an agreement with APS will allow the City to utilize the TOPS program in these situations. If the proposed resolution and agreement is approve by Council, staff will forward the contract to the Oklahoma Attorney General, as required by 74 O.S. Chapter 31 - Interlocal Cooperation Act § 1004, for a determination of whether the contract is in proper form and compatible with the laws of Oklahoma.
