BACKGROUND: This matter involves the workers’ compensation claim of Joshua Burkhalter, an employee of the City of Lawton, Fire Department who alleges injury to his right shoulder and right arm on February 7, 2022. Settlement has been reached subject to City Council approval with the claimant agreeing to accept the City’s offer of $20,000.00, including $4,000.00 as attorney’s fees and a $600.00 Multiple Injury Trust Fund Assessment payment to the Oklahoma Tax Commission.
It was the opinion of the City’s Workers’ Compensation attorney that the award was consistent with the medical evidence.
