BACKGROUND: The County maintains and operates the Comanche County Regional Juvenile Detention Center (CCRJDC) within the City of Lawton.  The City provides financial support to the County for the operation of the CCRJDC through a Juvenile Detention Agreement.   The Director of the CCRJDC has requested the City approve a memorandum of understanding (MOU) agreeing to make available resources from the Lawton Police Department to assist with the transportation of CCRJDC residents in the event an emergency renders the detention center unable to sustain operations and requires its relocation.  The proposed MOU states that any transportation assistance rendered by the police department shall be subject to the City's determination that sufficient police department resources are available to assist with such transportation without detrimentally affecting the City' s ability to provide law enforcement services to the community. The MOU is for the Fiscal Year 2023-2024 and shall be in effect July 1, 2023 and remain in effect until June 30, 2024, unless terminated sooner.  Additionally, the MOU may be terminated at any time by either party giving a 30-day written notice to the other party.

EXHIBIT:  Copy of the proposed Memorandum of Understanding

KEY ISSUES:  N/A

FUNDING SOURCE:  Absent an emergency, the proposed MOU has no additional costs. In the event of an emergency, there would be personnel costs, which would come from the police department’s 50000 and 50025 accounts. Fuel costs for transportation would come from equipment maintenance’s 51030 account.

STAFF RECOMMENDED COUNCIL ACTION:  Approve the proposed MOU between the Board of County Commissioners of Comanche County and the City of Lawton and authorize the Mayor and City Clerk to execute the document.
