Hold a public hearing and consider an amendment to Chapter 21, Lawton City Code, 2015, that amends Section 21-5-509, Chapter 21, Lawton City Code, 2015, by designating the required distance a residential estate subdivision can be away from a publicly dedicated sewer main before they are no longer required to connect to the publicly dedicated sewer main, providing for severability, establishing an effective date, and allowing floor amendments.

BACKGROUND: The current code requires a residential estate subdivision located within one-half mile (2,640 feet) of a publicly dedicated sewer main the subdivision shall be required to connect into the public main. This item went to CPC on April 13, 2023, and they recommended approval 5-0.
Division 18-11-1 - Residential Estate District
18-11-1-1102 - Purpose.
This district is intended to provide a location for those subdivisions that are to be developed using large lots with lower residential density than permitted in other residential district classifications. It is intended to provide a location for the subdivision situated on the fringe of the urban area, which will be undergoing urbanization in the near future or in locations where the lower density will provide a "buffer" for the U.S. Army Installation of Fort Sill.
18-11-1-1108 - Lot width.
There shall be a minimum lot width of one hundred fifty feet (150′) at the building limit line, and such lot shall abut on a street for a distance of not less than seventy-five feet (75′) except that on a cul-de-sac turn around this may be reduced to fifty feet (50′).
18-11-1-1109 - Intensity of use.                     
There shall be a minimum lot area of not less than one acre.
18-11-1-1110 - Lot depth.                     
The maximum depth of any lot shall not be more than four times the lot width at the building limit line.
The Hunt Addition located south of Lee Boulevard between SE Skyline Drive and Flower Mound Road is zoned Residential Estate District and is wanting to construct a second dwelling. They are within the one half mile of a 21” public sewer main and are currently required to connect to the public main instead of being allowed to use a septic system.  After discussion with Public Utilities, it was determined that the cost of a septic system is approximately $15,000 each and the cost of installing a sewer main is approximately $75.00 per foot. These numbers should balance.   The proposed tiering is listed below:

KEY ISSUES:  Our current Lawton City Code does require a small residential estate subdivision to install sewer if it’s located within one-half mile.

CPC RECOMMENDED COUNCIL ACTION:  Approve Ordinance No. 23-___, waive the reading of the ordinance, read the title only.
