Hold a public hearing and consider adopting an ordinance providing for the annexation of the Southwest Quarter of Section One, Township One North, Range Thirteen West of the Indian Meridian, Comanche County, Oklahoma, into the corporate limits of the City of Lawton, Oklahoma; providing that the annexed territory be zoned as Temporary I-4 (Heavy Industrial District) for a period not exceeding one year, superseding Ordinance No. 22-34, and by a separate vote declare an emergency.

BACKGROUND: On December 6, 2022, City Council held a public hearing and adopted Ordinance No. 22-34 annexing 160 acres of land owned by the Comanche County Industrial Development Authority (CCIDA), described as the Southwest Quarter of Section One, Township One North, Range Thirteen West, into the corporate limits of the City of Lawton.   In reviewing the December 2022 annexation of the aforementioned real property, staff recommended the annexation process be confirmed.   On December 6, 2023, the Comanche County Industrial Development Authority (CCIDA) filed with the city a petition for annexation requesting the annexation of the above-referenced real property into the City of Lawton, pursuant to 11 O.S. Section 21-105.  Notice of the presentation of the petition for annexation to the City of Lawton and that the City of Lawton will hold a public hearing at 2pm on December 29, 2023, to consider an ordinance for annexation of the aforementioned real property was published in The Lawton Constitution on December 8, 2023 and December 15, 2023.

 

The proposed ordinance sets forth the jurisdictional facts authorizing the annexation, to include among other things: (1) referencing the filing of the petition for annexation by CCIDA (the owners of the subject real property) with the City; (2) identifying the subject real property; and (3) stating that notice of the presentation of said petition was published at least once each week for two successive weeks - on December 8, 2023, and again on December 15, 2023 - in The Lawton Constitution; (4) stating that the property to be annexed is adjacent and contiguous to the City and is currently unimproved. The proposed ordinance also identifies the real property to be annexed and provides for the zoning classification of said land as “temporary” I-4 (Heavy Industrial District) zoning for a period of time not to exceed one year.  Within a year the land will have to go through the rezoning process for permanent zoning, per Lawton City Code, Chapter 18-1-1-110.

 

Finally, the proposed ordinance supersedes Ordinance 22-23, provides for severability, and declares an emergency.
