ITEM TITLE:

 

Hold a public hearing to consider a change of zoning from the R-4 High-Density Apartment District to C-1 Local Commercial District zoning classification and a change to the 2030 Land Use Plan from Residential/Low-Density to Commercial for the property located at 1212 NW Arlington Avenue, and if desired approve: (1) an ordinance changing the zoning and a resolution changing the 2030 Land Use Plan or (2) approve the Use Permitted on Review.

BACKGROUND:  This is a continuation of the item that was originally brought to Council on May 9. At that time, Council voted to table the item and bring it back once the CPC minutes have been included in the exhibit. Lawton Community Health Center (LCHC) is the owner of the properties located at 1212 NW Arlington Avenue, Lawton, OK 73507 (Lots 10-12, Block 14, of Mountain View). This property is located on the south side of NW Arlington Avenue between NW 13th St and NW 12th St. There was a vacant residential structure that had two structure fires May 5, 2022 and November 11, 2022. The land is currently vacant, and the proposed use for this property will be a parking lot.

                     The Notice of public hearing was mailed to 27 owners of property within 300 feet of the
             requested area on April 3, 2023, and proper notice was published in The Lawton
             Constitution on April 21, 2023.

                     Staff has reviewed the request, adding a tree buffer and an opaque screening on the west
            property line will be required. 
5.
                     The City Planning Commission held a public hearing on March 30, 2023 and
             recommended to marry lots 1-12, deny the rezoning and to bring it back as a use
             permitted on review. The applicant requested to move forward with the re-zoning rather
            than the UPOR.
6.         If the applicant needed to go back through the Use Permitted on Review process then it
            will add additional fees and approximately 60 days.

If Council wishes, the Use Permitted on Review can be approved without it going back through the process.

CPC RECOMMENDED COUNCIL ACTION:  Marry lots 1-12, deny the request to rezone from R-4 High-Density Apartment District to C-1 Local Commercial District zoning classification and a change to the 2030 Land Use Plan from Residential/ Low-Density to Commercial for the property located at 1212 NW Arlington Avenue, and require them to submit for a Use Permitted on Review or Approve the Use Permitted on Review.
