Consider approving $265,154.95 to be the actual cost of the dismantling and removal of the dilapidated building located at Block 63, Lots 17-32, Lawton Heights Addition (1301 NW Andrews Avenue) and ratify certification of said amount to the county treasurer.

BACKGROUND: In May of 2023, City Council approved a proposal/quote from Environmental Action Inc. for the demolition of the nursing home located at 1301 NW Andrews Avenue in the amount of $261,800.00. In September of 2023, City Council accepted Project EN2301 which was the demolition. State Statute states, "The governing body shall determine the actual cost of the dismantling and removal of dilapidated buildings and any other expenses that may be necessary in conjunction with the dismantling and removal of the buildings, including the cost of notice and mailing." The $265,154.95 amount includes cost of demolition, notice, lien filing fees, postage and research fees. This is also the amount relayed to the property owner as their personal obligation. It is anticipated the cost will be certified with the county treasurer prior to October 22nd, to ensure inclusion on mailing from the county treasurer. Therefore, the item includes ratifying the certification of the amount to the county treasurer.

Note: The above cost does not include a $9,163.00 fee charged by the state as a 3.5% CAP Fee on Asbestos Removal. Staff recommends not including this cost as doing so would require renotification to the property owner as well having to wait another six months to see whether property owner pays the invoice.

EXHIBIT: Invoice and letter mailed to Transforming Hand Inc. and JOCOG Ventures Realty LLC with cost breakdown in the amount of $265,154.95.
