BACKGROUND: On January 18, 2022, the nursing home at 1301 NW Andrews Avenue was brought before the City Council to be declared a dilapidated public nuisance. The structure had been boarded up, its utilities inactive since 2011, and it had experienced two fires. The City Council unanimously voted to declare it dilapidated, ordered the owner to abate the nuisance, authorized summary abatement, and directed the City Attorney to initiate legal action in District Court. On May 9, 2023, the Council approved the structure for demolition, which was completed on July 20, 2023. On September 26, 2023, the Council was informed that the City would pursue legal action against the property owner to recover demolition costs. At this time, the City Council requests an update on the status of cost recovery efforts to ensure full public transparency in the City’s stewardship of public funds. Any legal strategies required in the pursuit of cost recovery will be discussed in executive session.
