BACKGROUND: This agenda item is a companion to the proposed ordinance that will be considered in the following item. The ordinance outlines penalties for individuals who unlawfully camp on public property in non-designated areas without express consent of the City. For a first-time violation, the ordinance requires that a warning be issued, and no citation is to be given unless the individual refuses information or assistance offered by the arresting officer. This assistance may include information about or transportation to shelters, food pantries, or other resources aimed at supporting those in need and experiencing homelessness.
The purpose of this discussion is to provide the Council with an opportunity to clearly define the types of assistance to be offered and to identify the local resources available to individuals before any enforcement action is taken. By discussing these details in advance, the Council can ensure that the ordinance’s implementation will reflect a balanced approach, offering compassionate assistance while maintaining public safety.
