BACKGROUND: On August 8, 2024, Hilliary Communications LLC requested through the online Civic Access Portal a permit to install approximately 577.5 feet (35 rods) of fiber optic cable to serve an existing Verizon cellular tower located along the east side of NW 38th Street. The fiber run will start at their existing backbone located at the SW corner of NW 38th Street & NW Elm Avenue in an existing hand hole; thence running east, boring under NW 38th Street, a distance of 94 feet then setting a hand hole; thence running south paralleling the east side of NW 38th Street approximately 12 feet west of right-of-way a distance 483 feet then setting a hand hole; thence west a distance of 4 feet to an existing hand hole.
Article 20-4 of Chapter 20 of the Lawton City Code authorizes the issuance of a Revocable Communications Cable Permit with a $575 permit application fee plus a $24.15 per rod construction inspection fee thence an annual fee of $2.50 for each rod, or portion thereof, or, at the election of the City, five percent (5%) of the gross income earned by Permittee for the operation of its communications system within the corporate limits of the City.
