BACKGROUND: During a recent review of the Lawton City Code and the State Statutes that govern the Small Cell Wireless Facility Deployment, staff realized that we are limited on the amount that we can charge the applicants for Small Cell Wireless Facilities. It appears that staff missed the limit on the annual right-of-way occupancy when the code was drafted in 2021, because staff had placed the annual use fee at $250.00 per facility.
State Statute states that “the rate for occupancy of the right-of-way shall not exceed Twenty Dollars ($20.00) per year per small wireless facility.”
