INITIATOR: Christine James, Planning Director

STAFF INFORMATION SOURCE: Kameron Good, Senior Planner

BACKGROUND: On January 16, 2024, the Lawton Urban Renewal Authority requested that staff bring back a code revision to address their concerns regarding permitted uses in the mixed use district of the downtown urban renewal plans and which board/authority/commission has the authorization to determine "like" uses. Plan amendments were presented to LURA on February 20, 2024, and they recommended approval.

More specifically, this ordinance and resolutions will modify the existing City Code and each of the renewal plans by striking item 39. "Retail Sales and Services: General. Establishments engaged in the sale or rental of goods and services, both retail and wholesale, of commonly used goods, merchandise, and services" from the Mixed Use District of uses to be permitted.

Additionally, these will modify the language of item 45. "Uses which are similar in character to those enumerated above as determined by the Planning Commission, provided these uses are not more obnoxious or detrimental to the area in which it is located, by reason of noise, offensive odor, smoke, dust, vibration, traffic congestion or danger to life and property that those uses enumerated above." from the Mixed Use District of uses to be permitted. The change would replace "Planning Commission" with "Lawton Urban Renewal Authority".

The CPC held a public hearing on May 16, 2024 and considered the resolution.
