BACKGROUND: On September 12, 2023, City Council approved revocable permits for several small cell wireless facilities for US Cellular. Construction has begun on several of them around town. The facility located at or near 7990 NW Micklegate Boulevard was not constructed according to the approved plans. The facility would need to be moved 22 inches to the west and 3 feet to the north in order to be in compliance with the plans according to our inspector. Staff has also received various complaints from residents in the neighborhood regarding the proximity of the facility to the residences.
On May 28th, Council discussed this location and staff was directed to continue working with US Cellular. Staff has had several phone calls with US Cellular and they have agreed to relocate the facility. However, they do not have the new location completed settled on.
The code and revocable permit require notice be given of 90 days to remove the facility; however, the City Manager has requested that only 30 days be given to remove this facility.
