Consider holding a public hearing and approving an ordinance pertaining to Planning and Zoning amending Section 18-1-1-106, Division 18-1-1, Article 18-1; Section 18-6-12-624, Division 18-6-12, Article 18-6; and Section 18-6-14-646, Division 18-6-14, Article 18-6 all of Chapter 18, Lawton City Code, 2015 by creating a definition for crematorium and allowing crematoriums to be a use permitted on review within a C-5 General Commercial District and a permitted use within an I-1 Restricted Manufacturing and Warehouse District; providing for severability and establishing an effective date.

BACKGROUND: A citizen approached the planning division about what zone they are allowed to host their pet crematorium business. Currently, this use is not listed in Chapter 18. However, the use of a human crematorium is allowed as an accessory to funerals in the city.
Funeral home or mortuary are listed as a permitted uses in our C-1 Local Commercial District, C-4 Tourist Commercial District, and C-5 General Commercial District. While also being a Use Permitted on Review in the C-3 Planned Community Shopping Center District. All local business searches for local Lawton crematoriums show any funeral home with this accessory use to be located in the C-5 General Commercial District.
A discussion item was brought to the CPC on March 28, 2024, and it was determined that the use of crematoriums would be appropriate as a permitted use in I-1 Restricted Manufacturing and Warehouse District and a use permitted on review in C-5 General Commercial District.
The CPC held a public hearing on May 16, 2024, and considered the ordinance.
